Abstract
Aim: The aim of this retrospective study was to differentiate complication and malpractice in surgical cases and to help orthopedic surgeons.
Method: The database was obtained from Health Council Registrations and was based on 62 reviews of malpractice claims during the years of 1995- 2000. Result: Current data showed that a considerable amount of malpractice actions against orthopedic surgeons was resulting from lack of informed consent in majority of cases. 50% of surgery malpractice litigation appeared groundless and the incessant exposure to criticism and complaints might made innocent surgeons for less willing to take risks for their patients.
